KUALA LUMPUR: A husband's attempt to have his estranged wife declared mentally unfit through the courts ended in failure after the High Court ruled that the Mental Health Act (MHA) cannot be weaponised in a bitter matrimonial dispute.
Judicial commissioner Nixon Kennedy Kumbong dismissed the 42-year-old husband's application to compel his 39-year-old wife to undergo a psychiatric inquiry, saying the case was built on allegations, assumptions and hearsay rather than credible psychiatric evidence.
The court also found that the application was not brought in good faith but appeared to be a litigation strategy amid ongoing Syariah proceedings over their marriage and children.
